Technical and advisory groups created by the health benefit exchange board shall operate on an ongoing basis, meeting at least quarterly to report to the board on issues affecting consumers, with geographic diversity and diverse opinions represented.

Board must establish a public policy defining which exchange actions require public scrutiny, considering the effects those actions have on consumers.

Exchange must post notice of planned actions requiring public scrutiny on its website at least three weeks before the board meeting where the action will be discussed and provide time for public comments.

Board may bypass the public scrutiny process if immediate action is necessary to avoid disruption of exchange operations, but must make the action and reasons publicly available and report to the oversight committee.

Annual reports from the exchange board to the oversight committee must include major actions taken by the board, particularly those affecting consumers.
