HB 16-1165 Summary

• Authorizes state child support enforcement agency to issue administrative liens and attachments on insurance claim payments, awards, and settlements exceeding $1,000 from personal injury, wrongful death, or workers' compensation policies to collect past-due child support and maintenance obligations.

• Requires insurance companies, upon request, to obtain obligor's current address, date of birth, and social security number, and permits them to inform claimants that the request is for child support enforcement purposes; insurers are immune from liability for good faith compliance.

• Exempts insurance claim payment delays or denials from improper claim denial provisions when resulting from child support enforcement mechanism participation.

• Modifies child support guidelines to clarify adjustments for parents supporting other children, restrict retroactive child support modifications to five years prior unless substantially inequitable, and require annual information exchanges between parties on child support calculation changes.

• Effective January 1, 2017, subject to voter approval if a referendum petition is filed within 90 days of final legislative adjournment.
