HB 16-1205 Summary

• Allows two-wheeled motorcycles to drive between rows of motor vehicles (lane-splitting) when traffic is moving at no more than 5 miles per hour and the motorcycle travels at 15 miles per hour or less.

• Permits motorcycle overtaking on the right under the same conditions, provided the motorcycle does not exceed the surrounding traffic speed by more than 10 miles per hour.

• Prohibits lane-splitting and right-side overtaking when any vehicle is using the shoulder within the driver's visual range.

• Authorizes the Colorado Department of Transportation to notify the public about the legality of lane-splitting and advise drivers to use caution.

• Takes effect 90 days after the 2016 legislative session ends, subject to referendum petition requirements.
