HB16-1214 Summary

• Exempts discounted or donated medical marijuana to indigent patients and hospice patients from medical marijuana center production limits.

• Caps civil damages at $6,000 or actual damages (whichever is less) for lawsuits against law enforcement for destruction of medical marijuana plants.

• Requires courts to impose fines of up to $10,000 per day on defendants convicted of illegal marijuana cultivation, calculated from discovery date until the operation ceases.

• Moves the effective date for primary caregiver plant limits from January 1, 2017 to July 1, 2016 (36 plants unless the caregiver has a patient requiring extended plant count, up to 99 plants maximum).
