Department of Revenue gains authority to seize and destroy medical and retail marijuana containing harmful contaminants or unauthorized pesticides as determined by the Department of Public Health and Environment.

Testing requirements for marijuana products must include analysis for microbial contaminants, residual solvents, unauthorized pesticides, and chemical/biological hazards identified as public health risks.

Licensees may contest test results showing contamination by filing written notice within five days; Department must hold a hearing within two weeks and provide written determination.

Department of Revenue may immediately quarantine and destroy contaminated products once rules are promulgated and contest procedures are completed.

$23,753 appropriated to Department of Revenue from marijuana cash fund and $23,753 to Department of Law (0.1 FTE) for 2016-17 fiscal year to implement legal services related to this authority.
