HB 16-1307: Threats Against Persons at Postsecondary Educational Institutions

• Elevates threats of death or serious bodily injury at postsecondary educational institutions from a class 1 misdemeanor to a class 6 felony.

• Applies the enhanced penalty when threats involve death or serious bodily injury with a deadly weapon and are directed at students, school officials, or employees of postsecondary institutions, or invitees on the premises.

• Expands the definition of "credible threat" to include serious bodily injury with a deadly weapon, in addition to existing language covering bodily injury and death.

• Takes effect July 1, 2016, and applies to offenses committed on or after that date.

• May require a five-year appropriation to cover increased capital construction and operational costs for state correctional facilities.
