Prohibits the behavioral health unit in the Department of Human Services from collecting or retaining patient names, social security numbers, or other personal identifying information on or after December 1, 2016.

Requires the unit to complete a review of its policies and procedures, other states' policies, and federal requirements by December 1, 2016, to identify necessary changes for protecting patient personal identifying information.

Exempts from personal identifying information collection requirements patients whose care is paid for entirely by personal funds or private health insurance, except where required by Section 27-80-210, DUI probation monitoring, or federal and state public-funded services.

Mandates the Department include in its annual presentation to the Joint Committee of Reference information indicating how the unit has complied with patient privacy protection provisions.

Takes effect August 10, 2016, unless a referendum petition is filed, in which case it requires voter approval at the November 2016 general election.
