HB 16-1366: Enhanced Protections for Hearing Aid Purchasers

• Requires hearing aid providers and audiologists to disclose complete pricing including separate prices for parts, attachments, accessories, and related services, with rules allowing consumers to purchase components and services separately.

• Mandates that hearing aid providers explain to prospective and current users the different communication and connectivity options available through technological advances for various environments.

• Defines "locked" hearing aids as devices programmed to prevent adjustments or repairs by anyone other than the seller or their network, requiring providers to disclose this status in writing before purchase and provide lists of service providers and unlocking procedures.

• Designates violations of these disclosure and transparency requirements as deceptive trade practices under the Colorado Consumer Protection Act.

• Takes effect August 10, 2016, subject to referendum petition, and applies to hearing aid dispensing conduct on or after the effective date.
