• Codifies the roles and responsibilities of the State Archivist as head of state archives and records, replacing references to the executive director of the Department of Personnel.

• Creates two divisions within the state archives: a Permanent Records Program for records with legal, historical, or administrative value that remain in the archives, and a Records Center for temporary storage of records pending final disposition.

• Establishes that the State Archivist may accept records into the Records Center pursuant to written agreements with governmental agencies, with the originating agency retaining custodianship and paying storage fees deposited into a newly created State Archives and Records Cash Fund.

• Expands the definition of "governmental agency" to include state agencies and all county, city, special district, and other political subdivisions, broadening records management requirements beyond state agencies.

• Authorizes the State Archivist to promulgate rules for records criteria, maintenance, preservation, transfer, disposal, and public access procedures, and permits establishment of an optional Records Advisory Board with representatives from executive, judicial, legislative branches and local government entities.
