HB 16-1390 Summary

• Amends Colorado law to provide immunity from arrest and prosecution for persons involved in reported overdose events for specified drug and alcohol offenses.

• Underage persons who call 911 to report another underage person needing medical assistance due to alcohol or marijuana consumption are immune from criminal prosecution if they provide their name, are the first to report, and remain on scene to cooperate with responders.

• Extends immunity protections to the underage person who was in need of medical assistance if the conditions above are satisfied by the person who made the 911 call.

• Takes effect August 10, 2016, unless a referendum petition is filed, in which case the law requires approval by voters in the November 2016 general election to take effect.
