HB 16-1432 Summary

• Grants private sector employees the right to inspect and obtain copies of their own personnel files at least annually upon request, at a time convenient to both employer and employee.

• Permits former employees to make one inspection of their personnel file after termination of employment.

• Exempts from the law: documents required by federal or state law to be kept separately, confidential reports from previous employers, active criminal or disciplinary investigations, information identifying confidential accusers, and financial institutions (banks, trust companies, savings institutions, credit unions).

• Allows employers to restrict file access to occur only in the presence of a personnel manager or designated employee, and to charge reasonable duplication costs.

• Does not create a private right of action for violations, does not require employers to create or maintain personnel files, and does not apply to public employees who have access under the Colorado Open Records Act.

• Takes effect January 1, 2017, subject to referendum petition.
