HB 16-1437: School Bus Stop Arm Violations - Penalty Assessment

• Law enforcement agencies may issue penalty assessment notices to drivers or registered vehicle owners for school bus stop arm violations based on information obtained from any person and verified by law enforcement.

• Required information for penalty assessment notices must include the vehicle's color, basic description, and license plate number; circumstances of the alleged violation; violator identity; and time and approximate location of the violation.

• No points may be assessed against a driver's license for citations issued based on information other than that supplied directly by school bus drivers under existing procedures.

• The act takes effect on August 10, 2016, or following voter approval in November 2016 if a referendum petition is filed during the ninety-day period after final adjournment of the general assembly.
