Amends Colorado Revised Statutes 12-35-129 to allow licensed dentists and dental hygienists to pay independent advertising or marketing agents compensation based on results or performance on a per-patient basis.

Permits dentist or dental hygienist practices owned or operated by an authorized proprietor under section 12-35-116.5 to contract for business management services or pay royalties under franchise agreements without violating fee-sharing prohibitions.

Requires that contract or franchise agreement terms do not affect the exercise of independent professional judgment by the dentist or dental hygienist.

Takes effect at 12:01 a.m. on August 10, 2016, unless a referendum petition is filed within 90 days, in which case approval at the November 2016 general election is required.

Applies to conduct occurring on or after the applicable effective date of the act.
