Governor shall designate a state agency to promulgate rules establishing criteria that identify which pesticides may not be used in marijuana cultivation and processing under Article 43.4 of Title 12, C.R.S.

Designated agency may consult with other state agencies when developing the pesticide criteria rules.

Agency must publish a list of pesticides that meet the established criteria on its website.

Effective date is 90 days after final adjournment of the general assembly (August 10, 2016, if sine die is May 11, 2016), unless subject to a referendum petition.

Act applies to conduct occurring on or after the effective date.
