Senate Bill 16-058 Summary

• Establishes the "Colorado Cottage Foods Act" allowing home-based food producers to sell nonpotentially hazardous foods directly to informed end consumers without licensure or inspection.

• Permits sale of Tier One foods (pickled fruits and vegetables, spices, teas, honey, jams, baked goods, and similar items) and whole eggs (maximum 250 dozen per month) if producers earn no more than $10,000 annually per product.

• Requires producers to complete a food safety course including basic food handling training and mandates all sales be direct-to-consumer, Colorado-only, with no interstate commerce.

• Exempts poultry producers raising and slaughtering no more than 1,000 birds annually from most licensing requirements if poultry are raised on-farm, properly labeled, and processed under sanitary conditions.

• Appropriates $3,800 each to the Department of Agriculture and Department of Law for 2016-17 fiscal year to implement the act and establish a stakeholder group to develop regulatory framework for poultry processing.
