County boards of commissioners currently bear fiscal responsibility for providing and maintaining courtrooms and court facilities; this bill gradually shifts that responsibility to the state beginning in fiscal year 2017-18.

Counties must report fair market value rent for court facilities to the state controller and state property tax administrator by June 1 annually, starting in 2017.

The state will reimburse counties in incrementally increasing percentages of certified fair market value rent, starting at 5% in 2017-18 and reaching 100% by fiscal year 2036-37 and thereafter.

After the state assumes full fiscal responsibility, it may negotiate with counties to acquire the court facility properties instead of continuing rent payments.

The bill takes effect 90 days after the legislative session ends, subject to referendum petition procedures allowing voter approval in November 2016.
