SB16-082 Summary

• Prohibits homeowners' associations, their boards, managers, and any person acting on their behalf from retaliating or discriminating against unit owners who file complaints or reports about alleged violations of Colorado Common Interest Ownership Act (CCIOA) or related documents.

• Protects unit owners who participate in investigations, cooperate with complaints, or exercise any homeowner rights under the association's bylaws, articles, rules, declaration, or covenants.

• Allows unit owners to bring civil actions in county or district court for violations, with courts authorized to issue injunctions, award damages, court costs, attorneys' fees, or other appropriate relief if the owner prevails.

• Defines "violation" to include breaches of CCIOA, association bylaws and rules, declarations establishing common interest communities, and any covenants or documents setting forth association and unit owner rights and responsibilities.

• Includes a safety clause declaring the act necessary for immediate preservation of public peace, health, and safety.
