CO SB099

Authorizes the correctional education program to sell goods and services to inmates, invited guests, department employees, governmental agencies, and nonprofit organizations if the sales provide valuable educational experiences and fulfill program goals.

Requires the Department of Corrections to adopt procedures for hearing complaints of unfair competition from privately owned businesses, with the Executive Director making final decisions on complaints.

Mandates that prices for labor and goods/services be set as near as practical to prevailing market prices or prices charged through the Colorado community college system, with no warranties or refunds after 90 days.

Directs all revenues from sales to be deposited into the Correctional Education Program Fund for annual appropriation by the General Assembly, with unspent funds remaining in the account rather than reverting to the general fund.

Exempts the correctional education program from state restrictions on competition with private enterprise under Colorado law.
