Eliminates mandatory incarceration sentences for assault in the second degree under certain paragraphs, allowing courts discretion in sentencing while still following sentencing guidelines in section 18-1.3-406.

Retains mandatory minimum sentences for bail bond violations involving victims or witnesses, requiring at least one year imprisonment for subsection (1) violations and six months for subsection (2) violations, served consecutively with any underlying sentence.

Appropriates $65,788 to the judicial department for the 2016-17 fiscal year, including $61,085 for probation programs and $4,703 for courthouse capital and infrastructure maintenance.

Reduces Department of Corrections appropriations by $605,372 for in-state private prisons and $116,124 for pre-release parole revocation facilities in the 2016-17 fiscal year.

Takes effect July 1, 2016, and applies to offenses committed on or after that date.
