Prohibits the Department of Transportation and the High Performance Transportation Enterprise from requiring vehicle owners to purchase a switchable transponder or device to travel toll-free in high occupancy vehicles on HOV or HOT lanes.

Allows the Department to require installation and use of one switchable transponder or device for toll-free HOV travel, but cannot require purchase of the device.

Requires the Department to reimburse any vehicle owner who purchased a transponder or device before the effective date of this amendment with the full purchase price.

Mandates the Transportation Commission provide written notice to the General Assembly at least 12 months before implementing any three-or-more occupancy requirements for free HOV lane travel.

Takes effect August 10, 2016, subject to voter approval if a referendum petition is filed within 90 days after final adjournment of the General Assembly.
