Designates the database compiled by the Department of Public Health and Environment containing personal identifying information related to breath alcohol test results as non-public information.

Restricts disclosure of breath alcohol test information to: the test subject or their legal representative; named interested parties in related civil or criminal actions; prosecuting attorneys and law enforcement officers with legal authorization; and any party obtaining a court order upon showing good cause.

Permits courts to consider multiple factors in determining good cause for disclosure, including whether materials are evidentiary, relevant, and not otherwise obtainable through due diligence.

Allows the department to release non-personal identifying information from the database in accordance with Colorado's public records law (sections 24-72-101 to 24-72-402).

Takes effect at 12:01 a.m. on the day following the ninety-day period after final adjournment of the general assembly (August 10, 2016), or upon voter approval in the November 2016 election if a referendum petition is filed.
