Congress has prohibited federal spending on transferring Guantanamo detainees to U.S. facilities on five separate occasions since 2010, most recently in the FY 2015-2016 National Defense Authorization Act passed by veto-proof margins (91-3 Senate, 370-58 House) and signed November 25, 2015.

Colorado closed the Centennial South Campus correctional facility in Canon City in 2012 and authorized the executive director to sell or lease it, with lease-purchase payments costing Colorado taxpayers $20,258,268 in fiscal year 2016-2017.

Over 50 of the 91 detainees remaining at Guantanamo are deemed too dangerous to release to any other nation, and housing them in Colorado could endanger public safety through potential retaliation by international terrorist groups.

The resolution expresses the sense of the General Assembly that the Governor should not sell or lease state property to the federal government for purposes explicitly prohibited by federal law, citing constitutional principles of federalism and separation of powers.

Copies of the resolution shall be sent to the President, congressional leadership, the Secretary of Defense, Governor Hickenlooper, Colorado's congressional delegation, and the state Department of Corrections director.
