HB 17-1040 Summary

• Adds human trafficking crimes (sections 18-3-503 and 18-3-504 of Colorado law) to the list of offenses for which judges may issue ex parte orders authorizing interception of wire, oral, or electronic communications.

• Allows the attorney general, district attorney, or their designee to apply for communication interception orders when there is probable cause that evidence of human trafficking will be obtained or that a human trafficking crime will be committed.

• Takes effect September 1, 2017, unless a referendum petition is filed within 90 days after legislative adjournment, in which case it requires voter approval at the November 2018 general election.

• Applies to interception orders applied for on or after the effective date of the act.
