HB 17-1108 Summary

• Prohibits terminating the life of an unborn child beginning at fertilization and classifies violations as a class 1 felony.

• Exempts physicians performing medical procedures to prevent the death of a pregnant mother if reasonable medical efforts are made to preserve both lives in accordance with conventional medical practice.

• Exempts physicians providing medical treatment, including chemotherapy and ectopic pregnancy removal, that results in accidental or unintentional injury to or death of an unborn child.

• Exempts pregnant mothers from criminal penalties and does not prohibit the sale or use of contraception.

• Establishes that convictions for violating the prohibition constitute unprofessional conduct for physician licensing purposes; effective July 1, 2017.
