HB 17-1123 Summary

• Allows municipalities, cities and counties, and counties to extend hours for on-premises alcohol sales beyond the current state prohibition between 2 a.m. and 7 a.m. by adopting an ordinance or resolution.

• Modifies existing statute 12-47-901 to add an exception permitting local governments to override the state-mandated hours restriction for alcohol service.

• Creates new statute 12-47-314 establishing the mechanism for local governments to determine operating hours for alcohol-licensed establishments within their jurisdiction.

• Effective date is 90 days after final adjournment of the general assembly (August 9, 2017), subject to referendum petition and potential voter approval in November 2018.
