HB 17-1135 Summary

• Allows a single fingerprint-based criminal history record check to be portable across multiple child care facilities owned, operated, and controlled by the same common ownership group or school district.

• Extends portability to include checks of child abuse or neglect records maintained by the Department, in addition to criminal history checks.

• Eliminates the requirement for repeated background checks when a child care worker moves between facilities under the same common ownership, provided the ownership entity maintains a central records management system for all employees.

• Requires common ownership groups or school districts to take required actions based on background check results and notify the department when licensed facilities are added to or removed from their ownership or control.

• Effective date is August 9, 2017, or following approval by voters in the November 2018 general election if a referendum petition is filed.
