HB 17-1193 Summary

• Establishes expedited 90-day permit processing timeline for small cell facilities and small cell networks, compared to 150 days for new wireless facilities.

• Defines "micro wireless facilities" as small wireless facilities no larger than 24 inches in length, 15 inches in width, and 12 inches in height with antennas up to 11 inches long.

• Allows telecommunications and broadband providers to locate or collocate small cell facilities on local government-owned poles, light standards, and traffic signals in rights-of-way, except on tolling or enforcement equipment.

• Exempts micro wireless facilities suspended on cable operator-owned cables between existing utility poles from fee and permit requirements if compliant with national safety codes.

• Extends rights-of-way access afforded to telecommunications providers to broadband providers for all communications and broadband facilities, and establishes these as permitted uses by right in any zone.

• Effective July 1, 2017, applying to permit applications received on or after that date.
