HB 17-1249 Summary

• Increases penalties for unlicensed motor vehicle dealers, wholesalers, used vehicle dealers, buyer agents, wholesale auction dealers, and salespersons from class 1 misdemeanor to class 3 misdemeanor with fines of at least $1,000 and 25 hours of mandatory public service per offense.

• For corporations violating unlicensed vehicle sales requirements, establishes fines between $5,000 and $25,000 per offense, with second convictions subject to fines of $5,000 to $25,000 that courts cannot suspend.

• Creates exemption allowing business owners to sell up to 20 vehicles over a two-year period without licensure if vehicles have been owned for more than one year, used exclusively for business purposes, are titled to the business, and all applicable taxes are paid.

• Allocates fines collected from unlicensed vehicle sales violations equally between investigating law enforcement agencies and the auto dealers license fund to support enforcement of unlicensed sales regulations.

• Appropriates $8,000 from the auto dealers license fund to the department of revenue for GenTax IT system support during fiscal year 2017-18.
