House Bill 17-1293 Summary

• Allows local government officials who serve on nonprofit board of directors to vote on matters affecting the nonprofit without it constituting a conflict of interest or breach of fiduciary duty.

• Exempts officials from disclosure requirements unless they have a financial interest in the nonprofit or receive services from it independent of their board membership.

• Requires officials to publicly announce their nonprofit relationship before voting on matters that provide direct and substantial economic benefit to the nonprofit entity.

• Takes effect August 9, 2017, or following voter approval at the November 2018 general election if a referendum petition is filed within the ninety-day period after final adjournment.
