CO HB1330

Prohibits escape and attempted escape convictions from being used to adjudicate someone as a habitual criminal, unless the escape occurred from a correctional facility or county jail custody.

Excludes community corrections facilities and halfway houses from the definition of "correctional facility" for purposes of habitual criminal sentencing enhancement.

Adds definition of "community corrections facility" to Section 17-27-102 as a facility used by a community corrections program.

Effective date set for August 9, 2017, or subject to voter approval if a referendum petition is filed within 90 days after final adjournment of the general assembly.
