HB17-1334: Process Servers Registration Act

• Creates the "Process Servers Registration Act" requiring all process servers in Colorado to register with the Division of Professions and Occupations within six months of the effective date.

• Establishes registration qualifications including: minimum age of 18, lawful U.S. residency, completion of a four-hour education course covering civil procedure rules, harassment, trespass, safety, and address confidentiality programs.

• Requires criminal background checks for all applicants except licensed private investigators, with mandatory denial of registration for convictions involving unlawful sexual behavior, domestic violence, stalking, or protection order violations.

• Authorizes the Director to discipline registrants through fines up to $3,000 per violation, suspension, revocation, or probation, with penalties including Class 2 misdemeanor for first offense and Class 1 misdemeanor for subsequent violations of unauthorized practice.

• Schedules the process server registration program for automatic repeal on September 1, 2024, subject to legislative review under existing sunset laws.
