Declares positions of commissioner of education, assistant commissioners, and department positions classified as director, consultant, supervisor, instructor, and administrator are exempt from the state personnel system in accordance with the state constitution.

Authorizes the State Education Board to delegate to the Commissioner the authority to classify positions of employment as exempt under this section.

Allows employees holding exempt positions prior to January 1, 2017, to remain exempt from the state personnel system as long as they continue holding that position.

Prohibits positions from being determined exempt while held by an employee currently in the state personnel system.

Requires the Commissioner to submit an annual report to the State Personnel Director by December 31st listing all department positions exempt from the state personnel system.
