Senate Bill 17-002 Summary

• Repeals the Department of Regulatory Agencies (DORA) schedule-setting authority for rule reviews and establishes a mandatory triennial review schedule for all principal departments commencing in 2021.

• Requires each principal department to complete a comprehensive rule review by November 1 of each triennial year, assessing continuing need, appropriateness, and cost-effectiveness of all rules.

• Mandates that triennial reviews specifically evaluate whether any department rules are affected by federal or state laws enacted or rules promulgated within the previous three years.

• Requires agencies to provide public notice on their website and allow the public and other state agencies no fewer than 14 business days to submit input on rules under review.

• Mandates that all public input and input from other state agencies be attached to the rule review reports included in each department's departmental regulatory agenda submitted to the legislative council.
