Restricts habitual criminal designation to class 1, 2, or 3 felonies; class 4 or 5 felonies only if they are crimes of violence; and level 1 drug felonies only.

Prohibits use of class 4, 5, or 6 felony convictions for habitual criminal adjudication unless the conviction was for a crime of violence as defined in section 18-1.3-406(2).

Prohibits use of level 2, 3, or 4 drug felony convictions for habitual criminal adjudication purposes.

Maintains the requirement that a person have two or three prior felony convictions (depending on offense class) within 10 years to qualify as an habitual criminal, with prior convictions arising from separate criminal episodes.

Takes effect 90 days after final adjournment of the general assembly (August 9, 2017), subject to potential referendum petition and voter approval in November 2018.
