SB 17-015 Summary

• Creates new criminal offense in Colorado law for unlicensed persons who knowingly advertise the unlawful sale of marijuana, marijuana concentrate, or marijuana-infused products in newspapers, magazines, handbills, publications, or on the internet.

• Violation constitutes a Level 2 drug misdemeanor.

• Exempts primary caregivers as defined in Article XVIII, Section 14 of the Colorado Constitution who advertise their availability to serve as primary caregivers to patients.

• Takes effect September 1, 2017, subject to referendum petition and possible voter approval at the November 2018 general election.

• Applies to offenses committed on or after the effective date.
