SB17-032 Summary

• Amends Colorado Revised Statutes 12-42.5-404 to change access requirements for the prescription drug monitoring program for law enforcement officials and state regulatory boards

• Replaces the requirement of an "official court order or subpoena" with a "warrant issued by a neutral magistrate or judge following a showing of probable cause supported by sworn testimony or an affidavit"

• Applies to law enforcement officials accessing information specific to an individual patient, pharmacy, or practitioner as part of a bona fide investigation

• Applies to state regulatory boards within the division and the division director accessing information specific to an individual practitioner as part of a bona fide investigation

• Takes effect August 9, 2017, unless a referendum petition is filed, in which case it requires approval by voters at the November 2018 general election
