SB 17-038: Regulation of Home Inspectors

• Requires home inspectors in Colorado to register with the Department of Regulatory Agencies (DORA) Division of Professions and Occupations before engaging in home inspection activities.

• Establishes registration requirements including minimum liability insurance of $50,000 per individual/$100,000 per accident and a $10,000 surety bond.

• Creates disciplinary authority for the Director to deny, suspend, revoke, or place on probation home inspector registrations for violations, with penalties of $100-$5,000 per violation depending on offense severity.

• Excludes certain professionals acting within their scope of practice (licensed professionals, HVAC technicians, roofing contractors, code inspectors, and industrial hygienists) from home inspector registration requirements.

• Establishes a sunset date of September 1, 2023, with the article scheduled for legislative review under existing sunset laws; effective date is January 1, 2018, subject to referendum petition procedures.
