Health insurance carriers are prohibited from excluding or limiting coverage for any drug that was covered at the time an enrollee enrolled in their health plan, provided the health care provider continues to prescribe it and it remains safe and effective.

Carriers cannot increase an enrollee's copayment, coinsurance, or deductible costs for prescription drug benefits during the plan year, and cannot set new limitations on maximum prescription drug coverage during that year.

For health plans using tiered formularies, carriers cannot move a previously approved drug to a less favorable tier if the prescribing provider continues the prescription and the drug remains safe and effective.

The act takes effect January 1, 2018, unless a referendum petition is filed within 90 days after the legislative session, in which case voter approval at the November 2018 general election would be required.
