Senate Bill 17-190 Summary

• Prohibits insurance carriers from requiring dentists to charge fees set or approved by the carrier for dental services that are not covered by the patient's insurance policy.

• Allows dentists to charge patients for noncovered services at amounts the dentist determines and the patient agrees to, up to the usual and customary amount charged to uninsured patients.

• Requires covered services (those with available reimbursement under the plan) to be subject to carrier-set fees only if the carrier provides reasonable, non-nominal payment.

• Empowers the insurance commissioner to enforce compliance through corrective action plans or other enforcement mechanisms if carriers violate the prohibition.

• Applies to contracts entered into on or after August 9, 2017, subject to approval by voters in November 2018 if a referendum petition is filed.
