Senate Bill 17-229 Summary

• Expands "Move Over" law to require drivers to exercise due care when approaching or passing stationary public utility service vehicles displaying flashing, rotating, or oscillating amber lights, in addition to existing requirements for emergency vehicles and towing carrier vehicles.

• On highways with at least two adjacent lanes, drivers must move into a lane at least one moving lane apart from the stationary vehicle; if not possible due to weather, road conditions, or traffic, drivers must reduce speed and proceed with caution.

• Violations constitute careless driving with enhanced penalties: Class 1 misdemeanor if violation causes bodily injury to another person, and Class 6 felony if violation causes death.

• Establishes driver's license point system penalties: 3 points for standard violation, 6 points for violation resulting in bodily injury, and 8 points for violation resulting in death.

• Takes effect September 1, 2017, subject to potential referendum petition and voter approval at November 2018 general election.
