Authorizes county and district boards of health to establish retail food establishment license fees lower than state-set amounts if in compliance with food protection regulations.

Permits Denver to continue establishing its own retail food establishment license fees by ordinance, independent of state fee schedules.

Requires $43 of each collected retail food establishment fee to be transmitted to the state treasurer for the food protection cash fund to support department duties and responsibilities.

Restricts counties from using increased fee revenue for purposes other than retail food health-related activities through January 1, 2019.

Takes effect 90 days after final adjournment of the general assembly (August 9, 2017) unless a referendum petition is filed, in which case it requires voter approval at the November 2018 election.
