HB 18-1073 Summary

• Amends Colorado law to allow water district boards to sell, lease, or dispose of water use and capacity in works through contracts with public corporations, districts, utilities, persons, and private corporations for irrigation, domestic, municipal, industrial, commercial, or other authorized uses.

• Expands the types of contractual provisions that water districts may include in water contracts by allowing them to incorporate provisions from Section 31-35-402 (1)(h) as determined by the board.

• Authorizes districts and their water activity enterprises to contract with any other person, including other districts or water activity enterprises, for the use of water or water projects or facilities, with contractual provisions as determined by the district.

• Specifies that contracts must include security to secure payment, either as specified in Section 37-45-132 or such other security as the board determines appropriate.

• Takes effect August 8, 2018, unless a referendum petition is filed, in which case it requires voter approval at the November 2018 general election.
