Builders of new residences must offer buyers the option to include one of the following: an electric vehicle charging system, upgraded wiring to accommodate future installation, or a chase or conduit for future wiring installation.

The offer must be made according to the builder's construction schedule, including for prefabricated or manufactured homes.

Builders may apply the same terms, conditions, charges, and deadlines to electric vehicle charging upgrades as other upgrades, and may select the installation contractors.

Builders may stipulate in purchase agreements that upgrades are based on available technology at time of installation and that they are not liable for future modifications needed to accommodate electric vehicle charging systems installed later.

The requirement applies to contracts entered into on or after the effective date to purchase new single-family owner-occupied dwellings or condominium units, but excludes homes serving as sales inventory or model homes; effective date is August 8, 2018, unless subject to a referendum petition.
