HB 18-1110 Summary

• Prohibits state agencies and state employees acting in official capacity from knowingly assisting federal agencies in arresting Colorado citizens or lawfully present persons for committing acts protected by the Colorado Constitution

• Prohibits state agencies and employees from knowingly assisting federal agencies in violating Colorado constitutional rights of Colorado citizens or lawfully present persons

• Allows state participation in investigations until the state recognizes that the action being investigated is a protected Colorado constitutional right

• Defines "Colorado constitutional right" as a right enumerated in the Colorado Constitution that has not been declared unconstitutional by a federal court or Colorado appellate court

• Defines "knowingly" as awareness by the state, state agency, or employee that the act is a Colorado constitutional right
