HB18-1113 Summary

• Enacts the "Regulatory Reform Act of 2018" to provide enforcement relief for businesses with 100 or fewer employees on first-time violations of new regulatory rules.

• Defines "new rule" as any regulatory requirement enforced less than one year after its effective date and "minor violation" as non-safety-related violations involving record-keeping, data retention, or filing issues.

• Excludes from "minor violation" protections any matters affecting public safety, state-issued permits/licenses, federal law activities, consumer credit enforcement, civil rights rules, and Department of Public Health and Environment rules.

• Requires state agencies to develop and distribute fact sheets on new rules and issue written warnings with educational outreach instead of penalties for first-time minor violations by small businesses.

• Takes effect August 8, 2018, or upon voter approval if a referendum petition is filed within the 90-day period after legislative adjournment.
