HB 18-1132 Summary

• Department of Corrections must reimburse counties and cities and counties for expenses of confining and maintaining sentenced individuals in local jails for each day after 72 hours following sentencing until transfer to a state facility, subject to available appropriations.

• General Assembly shall annually establish the reimbursement amount in the general appropriations bill based on cost information reported by counties and cities and counties.

• Each county and city and county must report to the Joint Budget Committee by January 1 annually (beginning January 1, 2019) the average cost of confining persons in local jails for more than 72 hours after sentencing to state custody.

• Joint Budget Committee shall establish uniform reporting guidelines by September 1, 2018, requiring counties to report costs in categories including food, clothing and laundry, medical and behavioral health care, personnel costs, inmate transportation, and vocational training and educational costs.

• Department may contract with counties and cities and counties for expenses related to persons sentenced under section 16-11-308.5, subject to available appropriations.
