HB 18-1154 Summary

• Adds new statute requiring persons who solicit fees for deed or deed of trust copies to furnish the solicitation document to each county clerk and recorder at least 15 days before distribution.

• Caps fees charged for deed copies at four times the amount charged by the county clerk and recorder with custody of the document.

• Requires solicitations to display in at least 24-point type on top of document: statement that solicitation is not from a government agency, no action is legally required, the county's actual fee for the document, contact information for the county clerk and recorder, and the solicitor's name and physical address.

• Prohibits solicitation documents from using forms, deadline dates, or language that make them appear to be issued by a state agency or local government or that impose legal duties on recipients.

• Authorizes only the Attorney General or district attorneys to bring enforcement actions against violators, with penalties under Colorado's consumer protection laws applying.
