Authorizes the Colorado Department of Transportation to obtain and use location information from electronic devices in motor vehicles when derived from communication with highway infrastructure technology, notwithstanding existing warrant requirements under Section 16-3-303.5.

Limits use of location information to only facilitating transportation or managing traffic purposes and prohibits collection of nonpublic information communicated between vehicles or between vehicles and manufacturers without a legal order.

Restricts collection of personally identifying information to only what is necessary to administer high occupancy vehicle lanes or toll collection facilities.

Requires the Department of Transportation to publish terms of approval for automated driving system testing and protects trade secrets and confidential information from disclosure.

Act takes effect August 8, 2018, unless a referendum petition is filed, in which case it requires voter approval at the November 2018 general election.
