HB 18-1264 Summary

• Expands the definition of "posting a private image for harassment" (CRS 18-7-107) to include images displaying sexual acts, not just private intimate body parts, and adds "intimidate" and "coerce" as prohibited intents alongside harassment.

• Expands the definition of "posting a private image for pecuniary gain" (CRS 18-7-108) to include images displaying sexual acts of identified or identifiable persons eighteen years or older.

• Adds comprehensive definitions for key terms including "displaying sexual acts" (any display of sexual acts even without visible private intimate parts), "image" (photograph, film, videotape, recording, digital file, or other reproduction), and "sexual acts" (sexual intrusion or penetration as defined in CRS 18-3-401).

• Extends civil remedies to individuals who have had images displaying sexual acts posted, allowing them to recover injunctive relief, the greater of $10,000 or actual damages, exemplary damages, and attorney fees, plus retaining commercial use rights to their private images.

• Takes effect July 1, 2018, and applies to offenses committed on or after that date.
