HB 18-1314 Summary

• Prohibits operators of unmanned aircraft systems (drones) from obstructing peace officers, firefighters, emergency medical services providers, rescue specialists, or volunteers engaged in public safety operations.

• Provides an affirmative defense if a drone operator obtains permission from a coordinating law enforcement agency or emergency response entity, maintains communication with that entity, and immediately complies with all operational instructions.

• Declares that "obstacle" includes unmanned aircraft systems and defines "rescue specialist" as members of public or private rescue agencies, whether volunteers or compensated employees.

• Establishes public awareness efforts to reduce drone interference hazards and requires public safety agencies to make their presence known when entering scenarios where drone interference could create safety risks.

• Takes effect at 12:01 a.m. on August 8, 2018, or the day following the 90-day period after final adjournment, unless subject to a referendum petition requiring voter approval in November 2018.
